Terms of Service

1. Acceptance of terms

By creating an account or using PreFlight (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use PreFlight. These terms apply to all builders (account holders) and visitors to the platform.

2. Description of service

PreFlight is a waitlist management platform that allows independent developers and small teams (“builders”) to create and manage waitlists, collect subscriber emails, and send email updates to subscribers.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to use PreFlight.
• One person or entity may not maintain more than one free account.

4. Billing and subscriptions

Paid plans are billed monthly or annually via Stripe. By subscribing you authorise PreFlight to charge your payment method on a recurring basis.

• Free trial. Starter and Pro monthly plans include a 14-day free trial. No card is required during the trial. If you do not add a payment method before the trial ends, your subscription will not activate.
• Cancellation. You may cancel at any time. Cancellation takes effect at the end of the current billing period; you will not receive a refund for the unused portion of the period.
• Price changes. We will give at least 30 days’ notice of any price increase.

5. Acceptable use

You agree not to use PreFlight to:

• Send spam or unsolicited commercial email.
• Collect email addresses without the consent of the individuals.
• Distribute malware, phishing links, or harmful content.
• Violate any applicable law or regulation.
• Impersonate PreFlight or another person or entity.
• Attempt to gain unauthorised access to the Service or its infrastructure.

We reserve the right to suspend or terminate accounts that violate these rules without notice.

6. Your content

You retain ownership of any content you upload or create using PreFlight (waitlist names, branding, email copy, subscriber lists). By using the Service, you grant PreFlight a limited licence to host and transmit that content solely for the purpose of providing the Service to you.

7. Data and privacy

Your use of PreFlight is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring you have a lawful basis to collect and email your waitlist subscribers.

8. Intellectual property

The PreFlight name, logo, and all related software are owned by PreFlight and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without our prior written consent.

9. Service availability

We aim to keep PreFlight available at all times but cannot guarantee uninterrupted access. We may perform maintenance that temporarily limits availability, and we will try to give advance notice where possible.

10. Limitation of liability

To the maximum extent permitted by law, PreFlight is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data or revenue. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

11. Changes to these terms

We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of PreFlight after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
